Harris County's Response to the United States Department of Justice Civil Rights Division June 4, 2009 Civil Rights of Institutionalized Persons Act "Findings Letter Regarding: The Harris County Jail System

A voluminous response is presented that explains why Harris County “reflectively disagrees with the [U.S. Justice Department’s assertions that any of its practices or conditions have been or are unconstitutional or that there has been an alarming rate of in-custody deaths in the county” (p. 1). Sections comprising this document are: summary of Harris County’s response; scale of jail operations; CRIPA’s (Civil Rights of Institutionalized Person’s Act) framework; Harris County’s objections; the Civil Rights Division’s inconsistent findings compared to NIC (Nations Institute of Corrections), U.S. Marshall Service, and other experts; constitutionally adequate medical care, chronic care, and mental health care are given to Harris county inmates; constitutionally adequate protection from the use of excessive force is provided; constitutionally adequate sanitation and fire and life safety is provided; response to “Recommended Remedial Measures”; conclusion; and exhibits.
