Observations made by a group of former U.S. Attorneys that served during the period of 1995-2000 are supplied. Sections of this report include: participant list; is consistency attainable?; who prosecutes death-penalty-eligible cases?; deciding to seek the death penalty or not; U.S. Attorneys and the Justice Department; questions of racial/ethnic disparity; final thoughts; and a list of federal death penalty offenses. The former prosecutors do not believe an "overt bias" is to blame for the majority (72%) of those possibly facing the death penalty being minorities. The problem, they feel, is the inconsistent application of the laws nationwide.
