Ways to avoid conflicts between federal confidentiality laws and drug court operations are discussed. The primary problem is the restriction of information sharing that drug courts need to effectively operate. Most conflicts can be resolved by using consent forms drafted and executed according to section 290dd-2 of Title 42 of the U.S. Code. A discussion of these regulations is included along with sample waiver and notification forms.
