Trying Juveniles as Adults in Criminal Court: An Analysis of State Transfer Provisions

State transfer mechanisms differ from one another in where they locate responsibility for deciding whether or not juveniles should be prosecuted in a court exercising civil or criminal jurisdiction. This report discusses the three main transfer provisions, i.e. waiver, direct file, and statutory exclusion, as well as mechanisms by which individual cases may be moved from criminal to juvenile court, and other related subsidiary issues.
